WARRANTY AND REPAIR

WARRANTY

JcAIR. Inc., warrants its CDSbus™ products (hardware and firmware) against defects in materials and workmanship, and are warranted to meet the performance specifications as listed in the current catalogue and/or data sheet for the specific product being warranted. This warranty applies for three (3) years following the date of shipment.
JcAIR will, at its option, repair or replace, at no cost to the customer, products which· prove to be defective during the warranty period, provided the defect or failure is not due to misuse or abuse of the product. The customer is responsible for shipment of the defective product to the JcAIR factory. Software products are supplied on a site license basis subject to the same performance warranty provisions; the materials and workmanship
provision applies to the distribution media only. NO OTHER WARRANTY IS EXPRESSED OR IMPLIED, INCLUDING WARRANTY FOR FITNESS OF PURPOSE. JcAIR SHALL IN NO CASE, BE LIABLE FOR
CONSEQUENTIAL DAMAGES.

REPAIR AFTER WARRANTY
NOTE: The following repair policies apply only to equipment failures which resulted due to normal operations and handling. and are not a result of buyers neglect or misuse. JcAIR will repair products that have been neglected or misused, but will charge full time
and materials and reserves the right to warranty or not to warranty such products following repair.

Any item either repaired or exchanged will have a new six {6) month factory warranty. Freight charges to and from the JcAIR factory are the responsibility of the customer.

The following methods of repair are provided:

NORMAL REPAIR
Any JcAIR system options returned to the factory for repair will be billed at time plus materials. The labor will be billed at the current JcAIR  labor rate with a maximum of two hours being charged for any one repaired item. A minimum charge of one (1) hour will be assessed if no problems are found. At its option, JcAIR reserves the right to substitute a module of equivalent specifications and performance. Under normal circumstances. items will be repaired within five (5) business days of receipt of the item by JcAIR at its factory.

MAINTENANCE CONTRACT
A yearly maintenance contract is available covering normal repair. The cost is 5% of the current list price of the product(s) to be covered per year. Outside of the United States, this contract is only available to direct JcAIR customers. Under the terms of the maintenance contract items returned for maintenance will be repaired or exchanged. at JcAIRs option, and shipped back to the customer within five (5) business days of initial receipt of the item by JcAIR at its factory. The customer is responsible for shipment of the items to be repaired to JcAIR. JcAIR will return the item to the customer via the same method and priority as that used by the customer.

BOARD EXCHANGE MAINTENANCE CONTRACT
Within one ( 1 ) business day after receipt of a valid Purchase Order number from the customer, JcAIR will. on a best efforts basis, ship a replacement board of equivalent performance and specifications to the customer via the customers designated carrier. The cost is 140% of the list price of the board shipped. The customer will receive credit for 100% of the list price of the replacement board when a board of the same type is received by JcAIR at its factory.
Note: Board Exchange requires an in-place Maintenance Contract that will be billed at 6% of the current List Price of the covered product(s) per year.

QUALITY CONTROL
Quality of its products is of prime concern to JcAIR. In addition to stringent internal controls. JcAIR has either qualified under or implemented the following standards:

Underwriters Laboratory {UL)
Canadian Standards Assoc. (CSA)
